  1. Scope of Services

Passionate Awakenings, operated by David Imiri, provides coaching, consulting, and educational services in the areas of personal growth, relationship dynamics, and emotional well-being.

  • I am NOT a licensed therapist, psychologist, or medical professional. My services do not diagnose, treat, or offer medical or psychological therapy.
  • Coaching is a collaborative process focused on personal development and does not replace professional therapy or medical advice.
  • My services are for informational, educational, and transformational purposes only.
  1. Disclaimer of Liability

By engaging in my services, you acknowledge that:

  • I do not provide crisis intervention or emergency mental health services.
  • My services are for informational, educational, and transformational purposes only and do not constitute therapy or medical treatment.
  • You are responsible for your own decisions and actions. I am not liable for any direct, indirect, incidental, or consequential damages resulting from the use of my services.
  • If you are experiencing a mental health emergency, you should seek immediate assistance from a qualified professional or emergency services.
  1. Confidentiality

Confidentiality is a top value at Passionate Awakenings, and you are assured of confidentiality within certain limitations:

  • While I normally maintain full confidentiality, my services are not legally subject to therapist-client privilege.
  • If certain statements should remain confidential from a partner in your relationship, I ask that you state this explicitly. I will respect that, but I may ask that we discuss it.
  • I am not legally required to report certain disclosures, but I reserve the right to act at my discretion if I believe there is a significant risk to safety.
  • I may at times discuss your information privately with a professional colleague under their agreement of full confidentiality.
  • Confidentiality cannot be guaranteed in online communications (e.g., Zoom, email, text).
  1. Payment Policies
  • All sales and/or donations are final.
  • In the event that a service cannot be delivered or a genuine emergency occurs, exceptions may be made at my discretion.
    • A genuine emergency is an unexpected event that demands immediate attention to avoid dire consequences.
  • Sessions and packages are non-refundable unless otherwise stated.
  • 48-hour notice is required for cancellations or rescheduling. Late cancellations may be subject to a 50% cancellation fee.
  • Session packages and multi-session courses or events are contracts and non-refundable unless otherwise stated.
  1. Refunds & Cancellations

By purchasing any service, you agree to the following terms:

  • All sales are final except in cases of non-delivery of services or genuine emergencies.
  • 48-hour notice is required for cancellations, or a cancellation fee applies.
  • Session packages, training programs, or multi-session courses or events are contracts and non-refundable unless otherwise stated.
  1. Legal Jurisdiction & Dispute Resolution

By engaging in my services, you agree that:

  • These Terms shall be governed by the laws of Arizona.
  • Any disputes shall be resolved through non-adversarial and non-coercive dispute resolution methods, such as voluntary mediation or NVC-based negotiation, and are exempt from binding arbitration or other legal remedies.
  • You waive the right to bring a lawsuit in a public court except where legally required.
  1. Waiver & Assumption of Risk

By using my services, you voluntarily assume any associated risks and agree to hold me harmless from any claims, damages, or legal disputes arising from the use of these services.

  1. Acceptance of Terms

By using this website, purchasing a service, or participating in coaching, events, or programs, you acknowledge that you have read and agree to these Terms of Service.
